Federal Aviation Administration Contracting Regulations

One of the nation’s busiest airports uses a modern contract delivery method that was ineligible for federal airport grant funding. They enlisted Smith Garson to update FAA contract eligibility standards. We swiftly launched a strategy to incorporate these updates into the 2024 reauthorization. Smith Garson started our work in the early days of the reauthorization process to develop a succinct strategy that involved background research and meetings with the airport to fully grasp the issue. We transformed our extensive background work into fact sheets and proposed outcomes to educate congressional staff on the need to include the delivery method for federal funding and benefits to airports, customers, and the community.

Smith Garson hosted several meetings with Members of Congress, committee staff, and authorizing committee professionals to discuss the need to update eligibility standards. We coordinated purposeful visits for the airport officials, including personalized talking points and the latest updates on our meetings, so they could enhance our coordinated efforts. Smith Garson worked closely with staff of the House Transportation and Infrastructure and Senate Commerce, Science, and Transportation Committees. Our efforts culminated in working with a Member of Congress to draft legislative text for the FAA reauthorization legislation. This language was included in the final bill, resulting in the airport achieving a major eligibility win for future years of potential federal funding.

Funding for Affordable Housing and Transportation Infrastructure

County Government

With the 2021 return of Congressionally Directed Spending projects, Smith Garson has successfully secured $16 million in funding for a county client’s long-term strategic project to address affordable housing needs. Smith Garson and the County worked together to prepare competitive applications to the County’s delegation and held meetings with the Congressional delegation to educate them on the need, background, and information for a strong project.

Smith Garson also assisted the County as they pursued funding for a capital-intensive road project. In 2022, we played an important role in assisting the County in securing a $25 million Rebuilding American Infrastructure with Sustainability and Equity (RAISE) grant for a roadway upgrade. Smith Garson executed a tactical long-term plan prior to the release of the notice of funding opportunity (NOFO) announcement, which included regular communication between local officials, Department of Transportation officials, the Congressional delegation, and grant writers. Once the application was submitted, we continued our efforts by securing Congressional letters of support and encouraging local coalition support.

New Transportation Initiatives in Federal Law

Smith Garson provides strategic consultation services to a U.S.-based international association advocating for commuter transportation alternatives, utilizing transportation demand management (TDM). Transportation demand management is a growing strategy for the transportation sector.

Smith Garson helped raise the association’s profile in Washington, DC, including in Congress and across the Executive Branch, notably with the Departments of Transportation and Treasury. This included comprehensive Hill briefings, Washington, DC fly-ins, and Capitol Hill and executive branch meetings.

As we elevated the association’s profile, in 2020, we collaborated with Members of Congress to introduce legislation favorable to TDM, which resulted in the introduction H.R. 6770, the “Mobility Options, Resiliency, and Efficiency (MORE) through TDM ACT” (116th Congress). The bill included a wide-ranging federal proposal to address and support TDM strategies and goals that serve the mobility needs of people, as well as foster economic growth and development within and between states and urbanized areas. This effort resulted in the creation of a federal TDM definition in H.R. 2, the Moving Forward Act.

Smith Garson continued our achievements with the association in 2024. We secured report language in the Fiscal Year 2024 appropriations bill that directs the Federal Highway Administration (FHWA) to provide guidance on what TDM strategies and tools are eligible for Federal-aid highway funds. Additionally, the language requires FHWA to develop best practices and provide additional technical assistance to state departments of transportation, metropolitan planning organizations, and local governments to incentivize the use of TDM.

Additionally, Smith Garson advanced worked with Members of Congress to include a Government Accountability Office (GAO) study on the efficacy of Transportation Demand Management strategies at United States airports.
